Retreat Terms & Conditions
I (Jessica Rowley/The Facilitator) have created these Terms and Conditions so that there is a reference point for resolving any future disputes. Of course, I have read them (because I wrote them) and so it is also helpful if you (the Participant) have read them, as we are both entering into an agreement with each other. If I am co-facilitating a retreat with another person/persons then these terms apply to their involvement too.
RESERVATION AND PAYMENTS
Please check the reservation and make sure the details of what you think you have booked are all correct.
Please pay a non-refundable, non-transferable Initial Deposit of £150 of the total amount due for each person named in the reservation.
Please pay the Balance due not less than 30 days prior to the date of your retreat. Bookings made within the last 30 days before the start of the retreat, must be paid in full at time of booking. Payment can be made by bank transfer to my UK account.
The price is the exact amount to be received by me, irrespective of fluctuations in currency and irrespective of any third party transfer charges. When you pay by electronic transfer, please instruct your bank to charge all costs to you in order to avoid a shortfall in the amount that is received.
If payment of either the deposit or the balance is not received by the due date I will contact you to remind you, but I must also reserve the right to cancel the reservation and retain the deposit and re-advertise the room if I can’t contact you after making reasonable efforts to do so.
I am not liable for flight or other transport transfer costs, insurance or any other expenses incurred.
I reserve the right to offer discretionary discounts and this does not affect the status of any guests who have paid the full price and no discount will then become due to them.
CANCELLATION POLICY
I understand that you don’t book a retreat intending to cancel it, and of course I also have every intention of going ahead with the retreat as advertised and as planned, but sometimes life happens and so I have considered some eventualities and what my policy is on those things...
Please consider purchasing travel insurance to cover you for these possible non-refundable costs (see below) and please understand that it is your responsibility to read and understand the cancellation policies.
IF YOU NEED TO CANCEL
The Initial Deposit is non-refundable,
We do not offer refunds on your cancellation - if you are no longer able to make the retreat you can choose to defer your attendance to another retreat (or the same cost value on a future retreat) or you are welcome to find another person to take your spot.
If you are paying by payment plan, you will need to continue to pay the remaining balance of the course fee even if you are unable to attend. If a friend/someone you know can attend, you can transfer your booking to them for no additional fee. It is your responsibility to retrieve those monies from them. We will not be able to refund you and take new payment from them.
Exceptions cannot be made for any reason, including weather, injury/illness, or personal emergencies.
No refunds or credits for failure to attend or failure to complete the course, or for arriving late/leaving early or missing a session.
IF I NEED TO CANCEL
I reserve the right to cancel retreats with inadequate participant interest, in which case all money paid to me will be refunded. Where possible, notification of cancellation will occur at least 30 days prior to retreat start date.
In the event that one of the Facilitators cannot attend for health or personal reasons, then the retreat will be run by the other co-facilitator.
If both/all of the Facilitators cannot attend for health or personal reasons, or other situations beyond our control, all money paid will be refunded.
I cannot be held responsible for any personal expenses, such as airline tickets due to changes in itineraries or retreat cancellations (see below note on cancellation travel insurance).
Travel insurance
I recommend that you purchase your own travel insurance. I encourage you to purchase trip cancellation insurance in order that your trip fees will be covered should you or your family have a medical problem prior to your trip or while on the trip. Trip insurance should also be purchased to cover medical expenses in the event you have an accident while on the retreat, as well as covering you for the activities you intend to participate in (as well as the obvious activities like yoga, check for hiking etc), and also for potential damage to the rented property.
ACCESSIBILITY
I would really love for this retreat to be accessible to everyone regardless of mobility and stability (physical and/or emotional/mental). If you would love to attend but are concerned that you have a condition that might prevent you from doing so, please contact me first to see what extra provisions I may need to make, or to assess suitability.
HEALTH, SAFETY & PERSONAL WELL-BEING
You must comply fully with all and any health and safety regulations introduced by me.
You must ensure that you are medically and physically fit and able to use the facilities and participate in activities. If you have injuries or illnesses you are advised to seek doctor’s advice if practicing yoga/ Chi Kung etc
I am not liable for any injuries in the use of the facilities or participation in activities. A participant must always stop and rest if they are feeling any pain or sickness and inform the facilitator of any previous injuries or other conditions that affect your wellbeing.
If an accident happens or an emergency arises I will do everything I can to assist you but I am not responsible for the outcome of any such emergency.
Pregnancy & Yoga
Unless you have been a regular yoga practitioner for several years it is not advisable to practice yoga during the first trimester, particularly if there is any history of miscarriage. During the remainder of pregnancy, it is more suitable to attend pregnancy yoga classes.
However, I may make exceptions in certain cases, for example if I know you well and you have been a regular yoga practitioner for several years and you are used to yoga postures and if you have a letter from your doctor stating that it is safe for you to engage in the activities that we provide, then you may be able to attend during your second and third trimester.
If you fall pregnant between booking the retreat and coming, please get in touch with me immediately and seek our advice. We really strongly advise you don’t come in the first trimester. In the second and third trimester you are welcome to come and participate in the non-movement practices and generally soak up the lovely vibe.
PERSONAL CONDUCT
Please respect the policies of our host property, we expect you to behave in a way that is courteous, loving, respectful and responsible towards all people, property, plants and animals. Please refrain from behaviour which may be a nuisance or annoyance to the retreat and its guests, staff or owners. Please keep all fixtures, fittings, furniture and effects in a clean and good condition and be prepared to replace any articles which are damaged or missing with articles of a similar kind and of equal value.
We reserve the right at our sole discretion to terminate use of the property or any of its facilities by the participant in the event of any breach of these terms and conditions. The participant will be required to vacate the property and We shall not refund payment or accept any consequential liability damages or loss.
COMPLAINTS PROCEDURE
If you have a complaint, rather than discussing it with other retreat participants, I prefer that you come and speak directly with the me to allow for timely resolution and to ensure minimum disharmony in the wider group.
COPYRIGHT & WEBSITE
I retain all copyright licence rights & sole exclusive ownership of the information, photographs & material displayed on my website (credits given to photographers or direct quotes). The material may not be modified, copied or used in any way.
I accept no responsibility for keeping the website up-to-date and will not be liable for any loss by its failure to do so. I am not responsible for the contents of any external links displayed on my website.
DISCLAIMER
I and all persons involved in retreats (herein after referred to as "Facilitators") act only in capacity as Facilitators and guides for the participant in all matters connected with movement practices, guided meditations, workshops, massage or other therapies and creative activities. We are not responsible for travel, sight-seeing journeys and transportation, and as Facilitators hold ourselves free of responsibility for any damage occasioned by any cause.
Facilitators will not be responsible for any damages or expenses or inconveniences caused by late departures or change of schedule, strikes or to their conditions, nor will be responsible for loss or damage to baggage or any of the participant's belongings. All prices quoted are correct at time of publication, and are subject to currency exchange charges.
Facilitators shall not be responsible for personal injury, death, accident, delay, loss, damage, irregularity or property damage as a result of force majeure or for any other losses or damages incurred by any person or journey participants caused by any delay or change of itinerary or arising out of any act, including, but not limited to, any act of negligence, any person acting for or on behalf of Facilitators for transportation, accommodation or sight-seeing provider or any other person or entity rendering any of these services or accommodations being offered in connection with this journey.
This agreement supersedes all previous oral or written communications, representations, or agreements between the parties. Participants assume the risk involved when participating in yoga, foreign or local travel, and any and all activities and/or pursuits voluntarily undertaken while participating in the retreat.
Participants agree that any and all disputes between Participants and the Facilitators shall be governed by UK law.
Participants agree to mediate any and all disputes prior to the institution of any litigation. In the event of any litigation between the Parties to this agreement involving their respective rights or obligations, such litigation shall take place in London, UK and the prevailing party shall be entitled to recovery of reasonable legal fees and court costs of litigation.
In regard to the stay during the retreat, Facilitators will provide safe, careful instruction and safe premises, but ask that each participant to take personal responsibility for their own self-care and (in the unlikely case) for any injuries or emergencies incurred during retreat. Modifications are given to students with specific needs. If participants are unsure of their ability due to conditions or injuries, they should seek the advice of a healthcare practitioner beforehand.
